Cancellation policy

Introduction
Consumers have a right of cancellation as follows, whereby a consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity:

Right of cancellation
You have the right to cancel this contract within 14 days without giving any reason.

The cancellation period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

To exercise your right of cancellation, you must contact us (mofakult GmbH, Turmstr. 5, 78467 Konstanz, Germany, Tel.+49 7531 71 73 170, E-Mail: info@mofakult.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You can use the attached sample cancellation form, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.

Consequences of cancellation
If you cancel this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to cancel this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods immediately and in any case within fourteen days at the latest from the day on which you inform us of the cancellation of this contract.

Returns can only be sent to the following address:

The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling that is not necessary to check the nature, properties and functioning of the goods.

Exclusion or premature cancellation of the right of cancellation. Premature expiry of the right of cancellation

The right of cancellation does not apply to contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

The right of cancellation expires prematurely in the case of contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

The right of cancellation expires prematurely for contracts for the delivery of goods if they have been inseparably mixed with other goods after delivery due to their nature.

The right of cancellation does not apply to consumers who do not belong to a member state of the European Union at the time of conclusion of the contract and whose sole residence and delivery address are outside the European Union at the time of conclusion of the contract.

Unless otherwise agreed, there is no right of cancellation for contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for the provision of services. Accordingly, a right of cancellation is also excluded for contracts relating to the sale of tickets for scheduled leisure events.

General information

Please avoid damaging and soiling the goods. Please return the goods to us in their original packaging with all accessories and with all packaging components. Use protective outer packaging if necessary. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against transport damage.
Please do not return the goods to us freight collect.
Please note that the above paragraphs 1-2 are not a prerequisite for the effective exercise of the right of cancellation.

B.
90-day right of return

Independent of your statutory right of cancellation, we voluntarily grant you as a consumer the following right of return:

You can return all items from our shop to us within 90 days of receipt of the goods, provided that the goods are complete and in unused and undamaged condition. If the goods were delivered in sales packaging, they must still be in their original packaging. The timely dispatch of the goods is sufficient to meet the deadline.

If you make use of this right of return, we will refund the purchase price you have already paid, but not the shipping and return costs. You bear the transport risk. This right of return does not limit your statutory rights and therefore does not limit your right of cancellation in accordance with section A.
